Sense in what way?
You seem to be saying engaging in fraudish behavior is safer than being straightforward. That seldom "makes sense".
Put another way, it could mean you have a greater chance to elude detection entirely while increasing your chances of being prosecuted more rigorously if you are detected.

That's ridiculous....whether or not you are hiding it isn't going to effect how hard you are prosecuted.
Just go on the 2+2 forums in the affiliate/rakeback area and ask about "American" affiliates and see the response you get. No players want to have anything to do with American-based affiliates and all the affilaites that post there are based in other countries, even though they are mostly Americans. They also happen to be the biggest and most respected affiliates around.
But hey....feel free to openly flaunt your illegal activity in front of the US Gov. by making it extremely easy to build a case and prosecute you. Why not send the DOJ an email while you're at it

basically, what you pay in US$ you should be prepaired to pay in £ even though it's not the same exchange rate, even a bit more cos our tax is double what yours is. I have always had my sites served in London, I could have had a site hosted in LA its not fraudualent in any way it's 'remote' hosting!

You have to be joking. Obviously some people make more likely targets than others. You are saying that you won't be prosecuted harder for committing deliberate fraud on your taxes versus taking a simple deduction that is later disallowed.
This in fact is a key point now.

What does this have to do with anything? Rakeback has always been plainly illegal, and also immensely risky.

I don't engage in illegal activity. You have a pretty strange philosophy here.
The two types most at risk are the folks like Doyle who are in fact totally "out there" for everybody to see, and anyone trying to hide illegal activity. By hiding you are breaking other laws, like income tax fraud, and likely conspiracy laws that put you at both greater risk and offer greater penalties.

When did I mention evading taxes? I'm not talking about taxes, of course you should pay your income tax. This discussion has NOTHING to do with taxes.

That's exactly what you were talking about. You said you wanted to "make yourself appear as a non-american affiliate". It's what you were talking about even if you didn't mean it to be. Non-Americans not doing business in the US don't pay US taxes!

No, you said "make yourself appear as a non-american affiliate". We can't read your mind. Basing operations offshore provides zero benefit, and pretending to do so requires fraud and greater legal jeopardy. This is basically pretty obvious.
Facing your business internationally is completely different, even if that is inevitable when US players are impossible.
Whether you host in the US or UK is irrelevant to a US citizens legal jeopardy. If you have interaction with US players, your risk is the same. If you don't have interaction with US players, your risk is the same.
There are reasons to host outside the US, but personal legal jeopardy isn't one. Doylesroom registration and hosting doesn't make the slightest difference to someone like Doyle's legal jeopardy (as long as they take US players).
