Angry 1700 $ deduced from my revenue for "fraud" !!!

Pretty hot topic, so moved to the general area, JE.

This is related to the topic "stealing players from other affiliates".
PartyPoker has obviously started investigating players that have opened more than one account. There was a post about pokerstrategy, who quite openly encourage players by instructing them precisely on how to close their old accounts and open new ones (with their tracker of course). PartyPoker seems to have tolerated that, along with the obvious rakeback policy pokerstrategy has been practising. I wrote several emails about that to Party.

Now guess what : Now they investigated my account (it seems they did that with all the other accounts as well), and they accuse me of defrauding because I had "encouraged players to terminate their old accounts and create a new one", which I have never done !

IMO, if they allow a player to cancel his old account and create a new one, it's their problem ! After all, how could I know whether a player signing up with my bonus code has already had an account ? But now they put the blame on the affiliate, for a problem that they alone could have prevented.
As a matter of fact, I was told that they will deduce 1700 $ from my accruals until this sum is paid for .

This about closes it for me with Party. They tolerate pokerstrategy doing exactly this for months, if not years, and then they punish the small affiliates for bringing the topic up ? If they wanted to deduce all the revenues that pokerstrategy has made by stealing players from others, we'd be talking about six to seven figure amounts, but they will probably keep tolerating their stealing because PS is such a big affiliate !

Default Explain more about your $1700 charge please

Can you explain exactly how this fraud charge was applied to you? Was it in your affiliate stats account (reducing your accrued MGR) or your affiliate cashier account (reducing the amount you get paid)? Has the POSITIVE amount due to you in May been applied to your affiliate cashier account (chipping away at that $1700)? Thanks in advance.

actually I was told that they will "deduce the money from the affiliate MGR or hold back payment until 1700$ in accruals are reached". So far my account is still "under investigations", and I couldn't check it. Since my monthly accrual is usually lower than 1700 $, I will most probably not receive any MGR before the 1700 $ are accumulated.

What makes me most angry that as a reason for this they quote a clause that they have the right to hold back if the affiliate defrauds them (3.7 in the terms and conditions), thus accusing me of fraud ! IMO, they should have kept better control over their new sign-ins, checking names and adresses for double accounts, but that seems to have been too much work...

Same problem. This situation is very good, I collect players only to Empire Poker, but everybody had account in Party Poker. This was a big fraud lol. Of course these players can open their Empire account and can deposit and can play . Generate rake is not fraudulent.

They will take back the CPA that they have paid out.
Btw, Yesterday I was told by the aff. dept. that the player MGR will be re-credited to the affiliate who brought the double-account player in in the first place. Yes, and I believe in the easter bunny ...
Last october I actually told them that they should implement a control system to avoid creating of double accounts and eas told that they had one. Now they tell me they didn't have one then because the deemed it unnecessary. So whose fault is this in the first place ? Why should I be held responsible for their negligence ?

If they do credit the original affiliate, then there obviously is no negligence, only some affiliates getting short term loans from other affiliates, which is unfortunate but not that big a deal.

If original affiliates do get the money, this policy is the single greatest thing to happen to poker affiliates ever.

I agree with you if they will really do it which I doubt !
Question is why didnt they do it earlier. I started my website with a 50$ starting bankroll offer for the first subscribers, and it looks like many of them had accounts already. I asked Party to check them first, and they came back to me and said they are ok, so I transferred the 50 $, and now they take away the CPA for them. So in this case there is a negligence on their side.

does anybody know how long it takes them to check the accounts ? Do you think they will pay out until the july and want to know if you still bring them new players, this month I brought already 30, so would like to hear something ....

I can't wait to see what my negative number at Party is going to be...I'm going to get a real laugh out of it.

With close 10,000 free $50 accounts funded, I suspect it will be a pretty big number....LOL

On a serious note, I really suspect that Party could be facing a lawsuit from this if they hit the wrong affiliate with it. We never did anything to try and get people to set up secondary accounts. As such, we were never in violation of any aspect of the affiliate agreement.

I figure they'll think I owe them a good $50K. Yeah, good luck with that.

I'm so done with Party. The rules change every day...it gives me a migraine just trying to keep up.
