Images Use Rights

I know this gets a lot of debate from time to time but I have question for everyone.

If you give the original site/photographer the credit for an image can it be ok to use it?

Here is an example of where I think it may be OK and I don't think this works for all images or sites.

Say Full Tilt Poker has a number of pictures they took of one of their star players. In the course of advertising Full Tilt (the owner of the pictures) I claim that any picture used is the property of Full Tilt ans supply a link to Full Tilt's website. Can this be OK?

Since I'm advertising them and promoting them if I give all credit where it's due would this be considered fair?

Once again the site being promoted owns the images. I know they could ask them to be removed but I am wondering if this type of use on images is considered ethical since all credit is beign given.

I do that with FTP. I emailed them first and they had no problem with it.

Email them and keep the email they send back for your records.

hi

as a photographer a client or business eg. magic window co / fulltilt or a business figure / pro photographer would commission me to take pictures -

they would pay the photographer for a specific use NOT copyright (as this would be 10/20 times as much as a basic fee)

the specified use may be (usually is) for something like Public relations use - which has wide interpretation (but not actual rights) to use in all sort of places provided it is for public relations and not for advertising but see example below where someone like fulltilt or a poker professional may grant you free use -

They have paid for photographer to shoot and for them to use images for publicity / PR use which means they hand out the images to magazines / sites so they can use the images for FREE but ONLY in conjuction with that story or for publicity of that company / person

In the case of a pro endorsing a site they will have granted permission for their image to be used in conjuction with promoting the site & the photographer will have been paid to supply images for PR also

You need to ask fulltilt / poker pro if they have images that can be used for publicity of their site for free - provided this doesn't go against what the photographer has licenced the images for the client to use them for and the model (poker pro) has given permission then this is fine

in this example where the photographer / model (poker pro) & client (poker site) could all claim for aditional fees is if

a) third party (ie magazine / aff site) used images not in context of promoting / PR for original client - like a standalone profile with not big up to the site

b) the original client used it for an advertising (paid for marketing) rather than in editorial / PR material (as this is much bigger fee owed to photographer)

c) third party use images in own advertising

In short contact the site or the poker pro direct and ask if they have their own licenced PR shots which can be used for promoting / PR of the player / site
