52 pages and the word 'poker' is not mentioned once? Seems weird too me. This could be good as in poker is somehow a gray area and wont see much backlash or bad as in gambling is gambling whether you are betting on football or playing cards.

working my way through it (just finished the 30 page preamble); it seems to have been a complete punt by the Treasury (and Fed Board) on the issue; the proposed regs apparently just call for banks and other finacial institutions to implement appropriate policies and procedures to prevent money being transfered to foreign gambling companies. This is nothing new....the act already called for that, the regs were supposed to specifiy how this might be done and that doesn't appear to be what happened. The proposed regs also provide specific expemptions for the financial middlemen and orginiating banks (i.e., the gambler's bank and the clearing houses) for ACH, Checks, and Wires and puts the entire enforcement on the financial instution that would have a customer relationship with the gambling company (with a provision that tries to get at cases where this relationship is indirect).

Anyway, not much there, probably the best we could have hoped for - but this is just my first impression, I am going to read the actual regs themselves now (the preamble just explained what they were trying to do and areas where they are specifically asking for comments).

epassporte just started rejecting my debit card transactions which had worked up until about a week ago, so this IS having an effect

I don't think you can assume that anything that happens with epassporte is a direct result of anything else.

for those that want the quick version, section 6 is the operative part of the regs (page 44). My view is that the examples of appropriate policies and procedures are so broad that they are worthless. Its basically the Treasury saying that an appropriate procedure would be one that provides reasonable due diligence to know your customer.....so it just begs the question and tosses the issue back to the banks. I imagine the banks will comment heavily on this claiming that it is way too vauge....I also love that the implementation time is estimated at 25 hours. I'd like to see ANY procedure that is established by a bank that only takes 25 man hours to implement....
